Terms of Service
In short
- These terms are an agreement between you and DBCA Consulting Inc., which publishes Summit as DBCA Labs.
- You must be 13 or older to play. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you.
- Your Summit account starts as a guest account on your device. You can save your progress with an email address or, depending on your device, Google or Apple.
- Power-ups, Remove Ads and themes are a license to use inside the game, not property. They have no cash value. Items you buy don’t expire.
- Google Play or Apple handle payments and refunds. You keep every refund right the law gives you.
- Play fair. Cheating gets results removed and can get an account suspended.
- Your display name and scores are shown to other players, including in friend leagues. Invite links you share show your display name.
- Friend leagues and invites are optional. League names follow the same rules as display names, and invite rewards have limits.
- Nothing in these terms takes away rights you have under consumer protection laws.
1. About these terms
These Terms of Service (“terms”) are a legal agreement between you and DBCA Consulting Inc., a Canadian corporation that publishes Summit under the name DBCA Labs (“DBCA Labs”, “we”, “us” or “our”). They apply to the Summit game for Android and iOS, its online features (including friend leagues, invites and our invite pages) and these web pages (together, “Summit”).
By installing, opening or playing Summit, you agree to these terms. If you don’t agree, please don’t use Summit. You can read these terms at any time in the app (Settings > Terms of Service) and at dbcaconsultinginc.ca/summit/terms.
Our Privacy Policy explains how we handle your personal information.
If you are a consumer, you keep the rights that the consumer protection laws of your country, province or state give you. Where these terms conflict with those laws, the laws win.
2. Who can play
- You must be at least 13 years old.
- If you’re under the age of majority where you live, a parent or guardian must read and agree to these terms for you. Parents and guardians are responsible for a child’s use of Summit and for purchases they allow. Google Play and Apple offer parental controls for purchases.
- Where local law sets a higher minimum age, or requires a parent’s consent for using online services (in some European countries, up to age 16), you must meet that requirement.
- You can’t use Summit if we have banned you before, or if the law forbids you from using it.
3. Your account
- The first time you open Summit, it creates a guest account for you automatically. Until you save your progress, only the app on your device (or a backup of your device) can sign in to it.
- Your Support ID, shown in Settings, identifies your account when you contact us. Keep a copy of it.
- You can link your account to an email address and password, a Google account or Sign in with Apple (“Save your progress”, in Settings), so that you can get it back on another device or after reinstalling Summit. Which methods are offered depends on your device. Keep your sign-in details secure: you are responsible for what happens in your account.
- If you sign in to a saved game on a device where you have been playing as a guest, the guest’s progress isn’t added to the saved game. It is lost, including power-ups you bought, and Summit deletes the guest account. If that fails (for example, because the connection drops), the guest’s data stays on our server until you ask us to delete it. Remove Ads and themes bought with the device’s store account move to the saved game. Signing out of a saved game keeps your progress with your sign-in, and the device starts over as a new guest.
- If you haven’t saved your progress, uninstalling Summit, clearing its data or losing your device can mean losing your account and everything in it, including power-ups you bought. Your device’s own backup may bring it back. Store > Restore purchases delivers purchases that the store holds but that haven’t reached your account yet, and moves Remove Ads and themes bought with your Google Play or Apple account to your current Summit account (see section 5). If something is missing, contact us with your Support ID and, for Google Play purchases, the order number from your receipt (it starts with GPA.); for App Store purchases, the item and date of purchase. We’ll do what we reasonably can.
- You can delete your account at any time, in the app (Settings > Delete my account) or as explained on the Delete your account page. Deleting is permanent: the power-ups, items and standings in the account are deleted with it and aren’t refunded, except where the law requires a refund. You can still restore Remove Ads or a theme you bought on a new Summit account.
4. Display names
You start with an automatic name such as “Player4821” and can choose your own nickname. Names are 3 to 16 characters long (letters, numbers, spaces and underscores) and must be unique.
Your display name must not:
- be offensive, hateful, harassing, sexual, violent or discriminatory;
- impersonate another person, a brand, or DBCA Labs or Summit staff;
- contain personal information, such as a real name, phone number or address, whether yours or someone else’s;
- advertise anything or contain links;
- be illegal or infringe anyone’s rights.
An automatic filter checks names when you choose them. We may also change a name that breaks these rules back to an automatic name, without notice. Repeated breaches can lead to suspension (section 10). League names follow these rules too (section 8). To report a display name or a league name that breaks them, tap Report next to it in the app, or contact us (section 20).
5. Virtual items and purchases
What they are. Summit has virtual items, such as:
- power-ups (wildcards, reshuffles, extra time and kill rows), which you use during a game. You get 3 of each free when you start. While you have fewer than 3 of a power-up, you get one more free every 4 hours. You can also earn one by watching a rewarded ad (up to a daily limit), get some with invites (section 8), and buy packs and a bundle;
- Remove Ads, which turns off full-screen (interstitial) ads and adds 5 of each power-up, once;
- themes, which change how the game looks. You can buy a theme, or unlock it by watching rewarded ads (currently 5 per theme).
A license, not ownership. When you buy or earn a virtual item, we give you a limited, personal, non-transferable license to use it in Summit under these terms. Virtual items are not money or property. They have no cash value, can’t be exchanged for money or anything outside Summit, and can’t be sold, traded or transferred, except through features Summit provides.
No expiry. Power-ups and items you buy don’t expire. They stay in your account until you use them (power-ups), or until your account is deleted or terminated as these terms describe.
Payment. Prices are shown in the store screen. Payments are processed by Google Play or the Apple App Store under their terms, and the store collects any taxes. We never receive your card details. An item is delivered once the store confirms the payment and our server verifies it, which needs an internet connection. If an item doesn’t arrive, use Store > Restore purchases or contact us with your Support ID and, for Google Play purchases, the order number from your receipt (it starts with GPA.); for App Store purchases, the item and date of purchase.
Refunds. Purchases are final and non-refundable, except where the law or the store’s refund policy says otherwise. Refunds are handled by the store you bought from: see Google Play’s refund information or request one from Apple at reportaproblem.apple.com. If something went wrong, contact us too, and we’ll try to help.
Right of withdrawal (EU and UK). If you are a consumer in the EU or the UK, you may have a right to withdraw from a purchase within 14 days. Because virtual items are delivered right away, this right ends when delivery begins if, at checkout, you agreed to immediate delivery and acknowledged that you would lose it. The store you bought from may give you a cancellation right of its own; for example, Apple lets customers in the EU and the UK cancel App Store purchases within 14 days at reportaproblem.apple.com. If a purchase is cancelled or refunded, we take back what it gave you (see “Refunded or reversed payments”). Your other legal rights for faulty digital content are not affected.
Refunded or reversed payments. If a purchase is refunded or charged back, we take back what it gave you: the item is removed, and the power-ups it added are subtracted from your balance (never below zero).
Remove Ads and themes belong to one Summit account at a time. If you restore Remove Ads or a theme on another Summit account with the same Google Play or Apple account (for example, after reinstalling Summit, on a new phone, or after deleting your account), the item moves to that account. The bonus power-ups of Remove Ads stay with the account they were added to, and power-up packs and bundles never move. To prevent abuse, one purchase can move only a limited number of times a day.
Mistakes. If an item or balance is granted or removed by mistake, we may correct it.
Game balance. We may change Summit’s game balance to keep it fair and fun, or for technical or legal reasons: for example, scoring, difficulty, how power-ups work, free refills, rewards (including invite rewards), ad limits, and the prices of future purchases. We won’t take away power-ups or items you already have, except as these terms describe (refunds, mistakes, cheating or abuse, account deletion or termination, or Summit ending).
6. Ads
Summit is free and is supported by ads from Google AdMob.
- Rewarded ads are optional: you choose to watch one for a reward, such as continuing a game, a power-up, progress towards a theme or a league boost. A reward is given only after the ad network confirms you watched the ad. The rewards our server gives (power-ups, theme progress and league boosts) have a daily limit.
- Full-screen ads can appear after some games end. Remove Ads turns these off, but you can still choose to watch rewarded ads.
- Ads are provided by Google and its advertisers, and we don’t control their content. If you see an inappropriate ad, tell us.
- Don’t use automated tools to view ads or collect rewards.
Your ad and privacy choices are explained in the Privacy Policy.
7. Fair play
Summit is a competitive game, so please don’t:
- cheat, or use bots, scripts, macros, modified versions of the app, or tools that change how the game works;
- send fake data to our servers, or tamper with the app or our servers;
- exploit bugs (please report them instead);
- use several accounts, or work with other players, to manipulate leaderboards or leagues;
- create fake or extra accounts, or use several accounts, to collect invite rewards;
- send invites to people who don’t want them;
- interfere with, overload or probe the security of our servers;
- use Summit for anything illegal, or for commercial purposes without our written permission.
You’re welcome to stream, record and share Summit gameplay, including on monetized channels, as long as you don’t suggest we endorse you.
Our server automatically checks every game result. Results that aren’t plausible are flagged and don’t count on leaderboards or in leagues. If we find cheating or abuse, we may also remove scores, reset standings, rename an account, rename or delete a friend league, remove power-ups or items gained by cheating, by exploiting a bug or by abusing invites, or suspend or terminate an account (section 10). If you think we flagged you by mistake, contact us with your Support ID and we’ll review it.
8. Leaderboards and leagues
- Each week starts on Monday at 00:00 UTC. The weekly leaderboard ranks players by their best score that week.
- Leagues group up to 30 players in tiers from Bronze to Diamond. At the end of each week, the top players move up a tier and the bottom players move down.
- Only games that were started while online, reach our server within 6 hours of starting (the app sends finished games when you’re back online) and are accepted by our anti-cheat checks count.
- League boost: in the last 24 hours of a week, if you’re in your league’s demotion zone, you can watch a rewarded ad to earn one boost for that week. The next game you start with it counts double towards your league standing, if it is accepted and finished that week. It never changes your score on the weekly leaderboard.
- Other players can see your display name, scores, ranks and league tier.
- Leaderboards, leagues and trophies are for fun. They don’t award money or prizes.
- We may correct, adjust or reset leaderboards, leagues and friend leagues (including trophies) because of errors, cheating or technical problems.
Friend leagues. You can create a friend league, or join one with its invite code or link.
- A league has up to 50 members, and you can be in up to 5 leagues.
- Each member’s best score of the week counts, the same score as on the weekly leaderboard (a league boost doesn’t count there). Your whole week counts, including games you played before joining.
- On Monday, if at least 2 members scored the week before, the member with the top score wins a trophy. Members with equal top scores each win one. Trophies belong to your place in the league: if you leave it, or are removed, your trophies in it are lost.
- Members see each other’s display names, weekly scores, ranks and trophies, and the league’s name and invite code. Anyone with the code or link can see the league’s name and number of members.
League names. The player who creates a league names it, and its owner can rename it. League names are 3 to 24 characters long (letters, numbers, spaces and underscores) and don’t have to be unique. They must follow the same rules as display names (section 4), and the same automatic filter checks them. We may rename or delete a league whose name breaks these rules.
Owners. The player who creates a league is its owner. Only the owner can rename the league, remove members, get a new invite code and delete the league. A new code makes the old code and links stop working. A removed member can’t join again with the league’s current code; the owner can let them back in by sharing a new one. If the owner leaves or deletes their account, the member who has been in the league longest becomes the owner. When the last member leaves, the league is deleted. Deleting a league deletes everyone’s trophies in it, but nobody’s scores change.
Invites and rewards.
- Inviting friends and joining friend leagues are optional. You don’t need them to play.
- You share invites with your phone’s share sheet, or by copying the link. Only send them to people who would want them.
- If you’re new to Summit, you can accept one friend’s invite in the first 7 days after your account is created: by following their invite link (their personal link, or a friend league’s link they shared), by installing Summit from it on Android, or by entering their code in Settings > Have an invite code?. Following a link, or installing Summit from it, accepts the invite for you, even if you don’t join the league; entering a code asks first. You can’t accept your own invite, or the invite of a player who joined with yours, and you can’t change the invite you accepted.
- After you accept an invite, your next game that counts (see above) gives you 2 of each power-up, and gives the same to the friend who invited you (up to the limit below). Rewards are for playing, not for installing.
- A player is rewarded for at most 10 friends who join with their invite. After that, friends can still join with their link, and they still get their own reward.
- Rewards are power-ups (section 5). They have no cash value.
- These amounts and limits are the current ones. We may change them, or end invite rewards (section 5, “Game balance”). This doesn’t take away rewards you already have.
- If we find that invites were abused, for example with fake or extra accounts, we may remove the rewards gained (section 7).
9. Availability, changes and ending Summit
- You can play Summit offline, but leaderboards, leagues, friend leagues, invites, power-ups, saving your progress and purchases need an internet connection.
- Summit may sometimes be unavailable, for example during maintenance or outages. We may ask you to update the app before you can start a new game.
- We may change, add or remove features and content.
- If we decide to shut down Summit’s online services, we’ll give at least 30 days’ notice in the app (for example, in an app update) or on this website. When they shut down, unused power-ups and items end without a refund, except where the law requires one.
10. Suspension and termination
You can stop playing at any time, and you can delete your account (section 3).
We may suspend or terminate your account or your access to Summit if you seriously or repeatedly break these terms, if the law requires it, or to protect other players or Summit from fraud, abuse or security threats. Where it is reasonable, we’ll tell you why and give you a chance to contact us. If your account is terminated for breaking these terms, you lose the power-ups and items in it, without a refund unless the law requires one.
Sections that by their nature should continue after termination (for example sections 5, 11, 13, 14 and 15) continue to apply.
11. Our content and your license to use Summit
Summit, including its code, design, graphics, sounds, music, text, names and logos, belongs to DBCA Consulting Inc. or its licensors and is protected by intellectual property laws. Some parts are used under open-source licenses. They are listed at dbcaconsultinginc.ca/summit/licenses.
We give you a limited, personal, non-exclusive, non-transferable and revocable license to download and use Summit on devices you own or control, for your own non-commercial entertainment, under these terms and the rules of the store you got it from.
You may not copy, modify, distribute, sell or rent Summit, or reverse engineer it, except where the law allows this. If you send us ideas or feedback, we may use them without any obligation to you.
12. Other companies’ services
Summit relies on services from other companies: Google (Firebase Authentication, Google AdMob and Google Play), Apple (the App Store), Cloudflare and OVHcloud. If you save your progress with a Google account or Sign in with Apple, their sign-in services are also used. Your use of Google Play or the App Store is governed by their own terms. When you share an invite, the app you choose to send it with is governed by its own terms. We’re not responsible for other companies’ services, but this doesn’t limit our responsibility for our own obligations to you.
13. Warranties and disclaimers
We provide Summit with reasonable care and skill. Summit is a free-to-play game, and to the extent the law allows, it is provided “as is” and “as available”: we don’t promise that it will always be available, uninterrupted or error-free, or that progress or data will never be lost.
Nothing in these terms excludes or limits any warranty, guarantee or right that the law doesn’t allow us to exclude or limit, including under Quebec’s Consumer Protection Act, other provincial consumer protection laws, or EU and UK consumer law.
14. Liability
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or goodwill, arising from your use of Summit;
- our total liability for all claims relating to Summit is limited to the greater of (a) the amount you paid for purchases in Summit in the 12 months before the event that led to the claim, and (b) CAD $50.
These limits don’t apply to liability for death or personal injury caused by our negligence, for fraud, for gross negligence or intentional misconduct, or to any other liability that the law doesn’t allow us to limit or exclude.
If you are a consumer in the EU or the UK: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. If defective digital content we supplied damages your device or other digital content, and this happened because we did not use reasonable care and skill, we will repair the damage or compensate you.
15. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Ontario, Canada, have jurisdiction over disputes about these terms or Summit.
If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you can bring a claim in the courts there.
If you have a problem, please contact us first. Most issues can be solved quickly by email.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.
16. Changes to these terms
We may update these terms, for example when we change Summit or when the law changes. When we do, we’ll update the effective date at the top. If a change is significant and not to your benefit, we’ll tell you in the app (for example, in an app update) or on this page at least 30 days before it takes effect, unless we must change sooner for legal or security reasons. If you don’t agree with a change, you can stop using Summit and delete your account. If you keep using Summit after a change takes effect, the new terms apply.
17. Apple App Store terms
If you downloaded Summit from the Apple App Store, these additional terms apply. If they conflict with the rest of these terms, they take precedence for the iOS version of Summit.
- Parties. These terms are an agreement between you and DBCA Consulting Inc. only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for Summit and its content.
- License. Your license to use Summit is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Summit may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for Summit. Apple has no obligation whatsoever to provide maintenance and support services for Summit.
- Warranty. We are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Summit fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of Summit to you (Summit is free to download). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Summit, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Summit or your possession and use of it, including: (a) product liability claims; (b) any claim that Summit fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that Summit, or your possession and use of it, infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints or claims about Summit should be sent to DBCA Consulting Inc. (DBCA Labs), 47 Saint Ave, Bradford West Gwillimbury, ON L3Z 3E6, Canada, at support@dbcaconsultinginc.ca.
- Third-party terms. You must comply with any applicable third-party terms when using Summit, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
18. Google Play
If you downloaded Summit from Google Play, your use of Google Play, including purchases, is also governed by the Google Play Terms of Service. Google is not a party to these terms and is not responsible for Summit.
19. General
- These terms, together with the Privacy Policy and the terms of the store you got Summit from, are the whole agreement between you and us about Summit.
- If any part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a part of these terms right away, we can still enforce it later.
- We may transfer these terms to a company that takes over Summit. This won’t reduce your rights. You can’t transfer your account or these terms to someone else without our consent.
- We may send you notices in the app or on this website. You can send notices to us at support@dbcaconsultinginc.ca.
- These terms are written in English. If we provide a translation and there is a conflict, the English version prevails, except where the law requires otherwise.
